1.1 The website. Thank you for visiting www.superliquor.co.nz (Website) which is operated by Super Liquor Holdings Limited (SLH). SLH provides an online platform that allows customers to purchase goods from certain retail stores operated by separate Super Liquor franchisees nationwide. These terms and conditions of use of the Website (Terms and Conditions) form a contract between you and SLH. If you buy goods using this website, that contract is between you and the Super Liquor retail store that you buy from. SLH has no liability whatsoever in respect of those goods or their supply. These Terms and Conditions should be read in conjunction with the [privacy policy], and the [sale terms] between you and the store in respect of any purchases you make (together the Terms).
1.2 Right to use. You must be 18 years of age or over to access, browse and use the Website. When you visit the Website you irrevocably agree to these Terms. If you do not agree with any of the Terms, you must stop using the Website. You may access, view and print the content on the Website only for informational and non-commercial purposes. No part of the Website may be distributed or copied for any commercial purpose. SLH reserves the right to restrict or terminate your access to the Website at any time.
1.3 Intellectual property. All right, title and interest in all intellectual property relating to SLH and its affiliates on the Website, including, without limitation, text, graphics, data, goods pricing information, images, logos, trademarks, trade names and copyright is owned or licensed by SLH and its affiliates.. You are expressly prohibited from reformatting, reproducing, reselling or copying, by manual, or automated means such as scraping, any information, data or other material from this Website other than as strictly necessary to view the Website and make any purchase of goods from a retail store.
1.4 Changes to Website. SLH reserves the right to alter, suspend or remove the Website temporarily or permanently, at any time, or to deny you access to the Website for any reason and without notice.
1.5 Changes to Terms. SLH reserves the right to alter, change or modify the Terms at any time. If SLH decides to change the Terms, SLH will post these changes on the Website so that users are aware of the changes. By continuing to access the Website you agree to be bound by the amended Terms.

2.1 Third Party Sites & Hyper-linking. All links and references to other websites, are provided for your convenience only, and should not be taken as endorsement by SLH of those websites, the information contained in those websites, or of organisations or people referred to in those websites. If you have any comments or questions relating to any websites linked to the Website, please direct them to the relevant person or organisation. SLH does not (whether by implication or otherwise) endorse in any way any website, organisation or person who may have off-site links to the Website.
3. WARRANTY AND LIMITATION OF LIABILITY
3.1 Warranties. While SLH uses reasonable efforts to make sure that all information on the Website is current and accurate, SLH makes no warranty that information is up to date, accurate and correct. Further, SLH accepts no liability for any such erroneous information other than as required by consumer laws in New Zealand.
3.2 Limitation of liability. Other than as required by consumer laws in New Zealand, SLH will not be liable for any loss, including but not limited to, loss suffered caused by viruses, spyware or other similar software that may infect your computer equipment or other property from your use of, access to or downloading of any material from the Website. SLH has no liability in respect of any goods you may purchase from a retail store using this Website, or their supply.
4. GENERAL
4.1 Severability. If any provision or part-provision of these Terms and Conditions is or becomes void, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision will be severable and deemed to be deleted, and will not affect the validity, legality or enforceability of the remaining provisions.
4.2 Jurisdiction. These Terms and Conditions will be governed by and construed in accordance with New Zealand law. You agree to submit to the exclusive jurisdiction of the courts of New Zealand with respect to any claim or matter arising out of or in connection with these Terms and Conditions or their termination.

- Introduction
- Cashpoints is the loyalty program that Cashpoints New Zealand Limited (CNZL) provides in conjunction with Super Liquor Holdings Limited (we, us or our), participating Super Liquor stores and other participating retailers (Cashpoints).
- In return for you joining Cashpoints and receiving benefits associated with being a member of Cashpoints, you agree to
- the Cashpoints Terms and Conditions issued by CNZL, the latest draft of which can be found here (Cashpoints’ Terms); and
- these Terms which apply where you seek to earn or redeem Points when acquiring goods at a Super Liquor store (these Terms).
- You should read Cashpoints’ Terms together with these Terms. To the extent that there is any inconsistency or conflict between Cashpoints’ Terms and these Terms, the provisions of Cashpoints’ Terms shall prevail.
- If you do not agree to all of these Terms, you should not use your Cashpoints card or mobile application (Cashpoints app) to earn or redeem Points when acquiring goods at a Super Liquor store.
- If you use your Cashpoints card or Cashpoints app to earn or redeem Points when acquiring Qualifying Goods at a Super Liquor store (such use and acquisition being referred to in these Terms as a Transaction):
- you agree that CNZL can collect personal information relating to the Transaction and use it for various purposes in accordance with CNZL’s Privacy Policy (which can be found here; and
- where you have given CNZL your consent in accordance with CNZL’s Privacy Policy, CNZL may share your personal information relating to the Transaction and your Account with us as a Participating Retailer and we may use it for various purposes (including to provide directed marketing communications to you) in accordance with our Privacy Policy and the New Zealand Privacy Act 2020. - Definitions
- In these Terms, the terms Account, Business Day, Cashpoints Card, Participating Retailer, Participating Retailer’s Points Terms, Points, and Points Value have the meanings given to them in Cashpoints’ Terms (as amended from time to time).
- In these Terms, the following terms have the meanings specified:
- Super Liquor store means a Super Liquor retail store that is participating in Cashpoints; and
- Qualifying Goods means any goods that are on sale at a Super Liquor store but excluding those goods specified in the schedule to these Terms and such other goods that we determine and declare are not Qualifying Goods from time to time (either by an amendment to these Terms or by email to you).
- These Terms incorporate our Participating Retailer’s Points Terms.
- How to join
- It is free to join Cashpoints and the steps that you should take to join are set out in Cashpoints’ Terms.
- If you want a physical Cashpoints card, you can collect a card at a Super Liquor store. Otherwise, you can use a virtual Cashpoints card via the Cashpoints mobile application.
- While anyone aged 13 years or older may join Cashpoints, you must be aged 18 years or older to enter a Transaction (and thereby earn or redeem Points) at a Super Liquor store.
- Earning Points and other benefits
- Points are earned when you scan your Cashpoints card, or the barcode in your Cashpoints app, when acquiring Qualifying Goods at a Super Liquor store. Points cannot be earned when acquiring services (such as product hire or delivery) or on crate deposits. Points cannot currently be earned where you acquire product via our website.
- You will earn one Point for every full dollar spent in acquiring Qualifying Goods. For example, if you spend $64.99 in acquiring Qualifying Goods and $50.00 in acquiring tobacco or vaping products, you will earn 64 points.
- Each Point is worth the Points Value. The Points Value of one Point is currently one New Zealand cent, inclusive of GST (if any). To avoid doubt, while Points are worth the Points Value, they cannot be exchanged for cash at any Super Liquor store. Points can only be used for the payment (or part payment) of Qualifying Goods.
- Super Liquor stores may, from time to time, offer you additional promotional points or other benefits on such promotional terms and conditions as are notified (by us or a Super Liquor store) to you, and may include:
- bonus Points on acquisitions of selected products;
- competitions to win bonus Points;
- Prize draw entries; and
- giveaways and sample products.
- Super Liquor stores may, from time to time:
- offer you Cashpoints member only pricing on selected goods; and
- invite you to participate in specific sampling activities.
- Points expiry
- Points expire three years from the date that they are issued. Once Points have expired, they cannot be spent and will be debited from your Points balance.
- Redeeming Points
- Points earned by you in completing a Transaction will be added to the balance of Points in your Account. The Points Value of your Points can be used for the payment (or part payment) of Qualifying Goods from Super Liquor stores or qualifying goods or services from other Participating Retailers.
- If you want to redeem Points in respect of a Transaction:
- and the Points Value of your Points exceeds the price payable for that Transaction, you must pay for the Transaction solely by use of your Points; or
- the Points Value of your Points is less than the price payable for that Transaction, you must pay for that Transaction using all of your Points and the balance in cash, credit or debit card.
- You can earn Points on the balance of a Transaction where Points are redeemed as part of that Transaction. For example:
- Gross purchase amount $29.99
- Points redeemed -$10.00
- Net Purchase Amount $19.99
- Points earned 19
- Reviewing Points balance
- You can view your Points balance on your Cashpoints app or by logging into the Cashpoints website
- When you enter into a Transaction, the Super Liquor store member serving you will also be able to see your Points balance but will not otherwise have access to any other personal information that we hold about you.
- Returns
- Where a Super Liquor store agrees to you returning and being refunded the price of Qualifying Goods in circumstances where Points were used for the payment (or part payment) of those goods, then that refund will be dealt with by the Super Liquor store without the need for adjustment of your Points. However, the Super Liquor store will be entitled to deduct from the refunded amount the Points Value of any Points that you earned on your initial purchase of those Qualifying Goods.
- Exclusions
- As noted in clause 5 above, Points can only be earned on the purchase of Qualifying Goods from Super Liquor stores, which excludes those goods set out in the schedule to these Terms, and such other goods that we determine and declare are not Qualifying Goods from time to time (either by an amendment to these Terms or by email to you).
- Each Super Liquor store has discretion as to whether it will allow Points to be earned or redeemed on trade accounts or in respect of wholesale orders.
- Complaints, issues or queries
- Complaints related to the collection or spending of Points at a Super Liquor store should be promptly directed to that store in the first instance. If the Super Liquor store cannot resolve your complaint, they must, within five Business Days of you making a complaint, notify CNZL. CNZL may then endeavour to resolve your complaint.
- As we are a coalition partner of Cashpoints, any other complaints, issue or queries should be directed to CNZL directly.
- Changes to these Terms
- We may change or update these Terms (which include the Schedule to these Terms) from time to time. The change will be effective upon the posting of updated Terms on our website or otherwise notifying you in writing (including by email). When we update these Terms on our website, we will amend the “last updated date” set out at the start of these Terms and otherwise make clear on the website that these Terms have been updated. You should ensure that you have read and understand the most recent Terms posted on our website or otherwise notified.
- We will give you three months’ notice of any change to these Terms that we consider will reasonably impact you.
- By continuing to use Cashpoints and entering into Transactions after an update to these Terms, you are agreeing to be bound by the new Terms. If you do not agree to the latest set of Terms, you must not enter into Transactions.
- Liability
- To the maximum extent permitted by law (including the Consumer Guarantees Act 1993), you agree that:
- we are not liable to you for anything in connection with your purchase of goods from a Super Liquor store; and
- neither we nor any Super Liquor store are liable to you for any:
- delay or failure by a Super Liquor store to notify CNZL of the details of the purchase of a Qualifying Good; or
- delay or failure by CNZL to meet the Cashpoint Terms or the Cashpoint Privacy Policy.
- To the maximum extent permitted by law, we are not liable to you for any consequential, indirect or special damages of any kind arising from your use of Cashpoints.
- These Terms will be governed and construed in accordance with the laws of New Zealand. You consent to the exclusive jurisdiction of the courts of New Zealand in connection with any legal action that may arise in relation to these Terms or Cashpoints.
